D. Bylaws of the Classified Employees Council

Article I — Origin

The Classified Employees Council (CEC) was established by the President of Idaho State University at the recommendation of the Ad Hoc Committee on Staff Inservice Training and the Affirmative Action Policy Committee.

Article II — Function

Section 1: General Function. The CEC is an elected body that represents the interests of the Classified Employees by working with other components of Idaho State University for the improvement of personnel management, morale, working conditions, and productivity.

Section 2: Specific Functions:

A. To provide leadership to Classified Employees in the promotion and development of programs, policies, and procedures which enhance Idaho State University in the pursuit of its mission.

B. To promote an active role for the Classified Employees in the University governance structure.

C. To study and make recommendations concerning the establishing, interpreting, and publicizing of the University operating policies and procedures affecting Classified Employees.

D. To make recommendations on behalf of the Classified Employees in policy matters pertaining to personal and professional welfare.

E. To study problems and/or potential problems of Classified Employees and to cooperate with the Faculty Senate in the formulation of joint recommendations concerning the solution of problems common to faculty and Classified Employees.

F. To study and evaluate the University interpretation and application of Idaho Personnel Commission rules and regulations and make recommendations to the (University) President.

G. To form committees, as required, to study special and/or continuing problems and report to the Council.

Article III — Constituency and Membership

Section 1: Constituency. The Classified Employees Council shall represent the Classified Employees of Idaho State University.

A. Criteria for identification as a Classified Employee of Idaho State University includes:

(1) Employment in a permanent position that falls under the policies of the Idaho Personnel Commission at Idaho State University.

(2) Employment in a position on a half-time or greater basis.

(3) Either achievement of permanent status or at least six months service in the position. A person ceases to be a Classified Employee of Idaho State University upon termination of employment at the University.

Section 2: Representation.

A. Representation on the Council shall be based on distribution of Classified Employees in the groups identified below:

(1) Classified Administrative/Executive Professional

(2) Secretarial/Clerical

(3) Technical/Paraprofessional

(4) Skilled Crafts

(5) Service/Maintenance

B. Each group listed above shall be represented on the Council by one elected member for every fifty (50) employees or major fraction thereof, provided that each group shall have at least one representative member on the Council. Only elected representatives shall have a vote. The Human Resources Director shall serve as an ex officio (non-voting) member.

Section 3: Eligibility. All full-time Classified Employees, including academic year employees, who have been employed in a permanent position at Idaho State University for one year or more are eligible for membership on the Council.

Section 4: Terms. Council members shall be elected for staggered three-year terms. No Council member may be elected two consecutive terms to succeed himself/herself.

Article IV — Officers and their Duties

Section 1: Officers. The Council will elect two officers, President and Vice President, at the first regular meeting following each election. The term of office will be for one year. Only continuing Council members or newly-elected members will be eligible to vote for the President and Vice President. Only those persons who have served on the Council for at least one (1) year shall be eligible for election to the offices of President and Vice President.

Section 2: Duties of the President. The President shall:

A. Appoint a recording secretary, subject to the approval of the Council.

B. Appoint a parliamentarian.

C. Preside at all meetings of the Council.

D. With the approval of the Council, appoint required committees.

E. Maintain lines of communication between the Council, the University President, the faculty, and non-classified employees.

F. With the approval of the Council, nominate representatives to University level-standing committees, where appropriate.

G. Perform all other duties pertaining to the Office of President.

Section 3: Duties of the Vice President. The Vice President shall:

A. Assume the duties and responsibilities of the President in the event of absence or disability.

B. Carry out responsibilities pertaining to election proceedings as outlined in these bylaws.

C. Perform such other duties as may be assigned by the President and/or the Council.

Section 4: Duties of the Recording Secretary. The Recording Secretary shall:

A. Maintain an accurate record of all meetings of the Council.

B. Submit a summary of the minutes for publication in the campus media as soon as possible after the full minutes have been approved. The summary shall include a statement that a complete copy of the minutes is available upon request.

C. Prepare reports of recommendations for presentation at the request of the Council President.

Article V — Elections

Section 1: Continuity. To provide continued membership on the Council, approximately one-third (1/3) of the membership positions shall be filled each year. At no time can more than two members of the same group (see Article III, Section 2) serve the same term.

Section 2: Elections. The Vice President of the Council shall annually, in January, appoint an elections committee from the membership-at-large. Prior to elections, the elections committee shall call for nominations from the membership-at-large and with the assistance of the Council representatives. The call for nominations must be publicized in the campus media twice in the month of February.

Nominations must be in writing and signed by the nominator. Nominees’ names must be published in the campus media at least twice in March. Voting shall be by the membership-at-large.

The Elections Committee shall:

(1) Confirm the eligibility and availability of each nominee;

(2) Prepare and distribute ballots, ensuring that each eligible staff employee has an opportunity to vote;

(3) Collect and count the ballots; and

(4) Report the election results to the Council.

Election shall be by simple majority of the members voting.

Elections shall take place the last week in March.

Section 3: Validation. At the Council’s next regular meeting after the election, the election results shall be validated and the winning candidates named. The order in which all candidates finished in the election shall be recorded. Those elected shall be seated as Council members at the first regular meeting in May.

Article VI — Vacancies

Section 1: Vacancies that need not be filled. Vacancies occurring 60 days or less before April 1 need not be filled before the regular elections.

Section 2: Appointment to vacancies. When possible, vacancies shall be filled by appointment of the candidate who, at the most recent election for the position vacated, had the highest number of votes. If the vacancy cannot be filled in this way, the Council President shall appoint, subject to Council approval, a person from the same constituent group to complete the unexpired term. A person appointed to serve less than half a full term shall be eligible for election to the succeeding term.

Section 3: Vacancies due to unexcused absence. A vacancy occurs when a member of the Council, unless excused by the President of the Council, is absent from three consecutive and properly called meetings.

Section 4: Replacement of officers. In the event of a vacancy in the Office of President, the Vice President shall assume that office. In the event of a vacancy in the Office of Vice President, the Council may elect a replacement

Article VII — Executive Board

Section 1: Membership. The Executive Board of the Classified Employees Council of Idaho State University shall consist of the President and Vice President of the Council and three (3) members elected by the Council.

A. Elections shall be in the same manner and at the same time as the elections of officers of the Council.

B. The terms of office shall be one (1) year.

C. Three (3) members shall constitute a quorum.

Section 2: Duties.

A. To supervise the business of the Council between regular meeting dates.

B. To perform other duties as are specified in the bylaws or as may be assigned to it by the Council. The Executive Board shall not revoke or contravene the general policies of the Council.

Article VIII — Council Meetings

Section 1: Regular Meetings. Meetings of the Council shall be held monthly during the regular school year at a time and place to be designated at the first meeting each year.

Section 2: Special Meetings. The Council President may call a special meeting at any time. Notice of a special meeting may be verbal and must be given at least 24 hours prior to the meeting. Each member shall be notified, either verbally or in writing, of the meeting and informed of its purpose. Special meetings will be restricted to the stated purpose for which they are called.

Section 3: Quorum. A quorum shall consist of not less than half of the voting members of the Council.

Section 4: Agenda. The Council President shall be responsible for the preparation of the agenda and shall distribute it to the members at least five (5) working days before each regular meeting.

Section 5: Record of Attendance. The minutes of each meeting shall show the names of Council members present, those excused, and those unexcused.

Section 6: Open Meetings. The Open Meeting Law of the State of Idaho will be observed.

Article IX — Meetings of Classified Employees Council

Section 1: Regular meetings. There shall be at least one open meeting held each semester of the regular school year for the purpose of conveying information, receiving constructive suggestions, and conducting other relevant business. Notification of an open regular meeting shall appear in the campus media at least one week before a meeting. The President of the Council shall preside at these meetings.

Section 2: Special meetings. Special meetings of Classified Employees Council may be called by: (1) the Council; (2) the Council President; or (3) the Council President following a written request of at least 50 members of the Classified Employees Council. Notification of the special meeting and its purpose shall appear in the campus media at least one week before the meeting. Special meetings will be restricted to the stated purpose for which they are called. The President of the Council shall preside at these meetings.

Article X — Parliamentary Authority

Section 1: General. Roberts Rules of Order, Newly Revised (1981), shall govern all meetings of the Council and of the Classified Employees Council in all cases to which they are applicable and in which they are not in conflict with these bylaws or with any other rules that are adopted by the Council or the Classified Employees Council for the conduct of their meetings.

Article XI — Amendments of Bylaws

Section 1: Amendment proposals. An amendment may be proposed by the Council or by a majority vote of those present in a special meeting of the Classified Employees Council. Proposed amendments shall be published in two consecutive issues of the campus media as well as posted and distributed among the membership.

Section 2: Ratification. These bylaws may be amended by a two-thirds majority vote of the Classified Employees Council voting, provided that those voting constitute at least 51 percent of the total membership. Voting shall be by mail ballot. Results of the ballot shall be published in the campus media.

These bylaws and amendments thereto are subject to review and approval by the President of Idaho State University.
