2011-2012 Provisional Faculty Senate Actions
Approved February 6, 2012:
Motions passed:
- “I move that a request be made to the Interim Provost that all faculty governance documents that were submitted, even if subsequently withdrawn for the SBOE meeting set for February 16, 2012 be circulated to all faculty by Wednesday, February 8, 2012. Faculty governance documents in this motion refer to faculty governance, governance principles, constitution, bylaw or any other documents that bear upon faculty governance.”

- “I move that the Provisional Faculty Senate endorse the following resolution and that the PFS Executive Committee, to the best of its ability using available mechanisms, transmit the resolution to the ISU faculty, the ISU administration, the Idaho State Board of Education, and to the public:
Be it resolved
The ISU Provisional Faculty Senate, consistent with overwhelming faculty consensus, accepts the governing principles granted to the faculty of Boise State Univesity by the Idaho State Board of Education throughthe Board’s 2011 approval of the Boise State University constitution. The Provisional Faculty Senate recognizes that identical governing principles are embodied in the draft ISU constitution that was approved by the ISU faculty.The Provisional Faculty Senate, consistent with overwhelming faculty consensus, rejects the governing principles advocated by ISU President Arthur Vailas and communicated to the ISU faculty through Interim Provost Barbara Adamick in her 2011-12 public and university communications on governance. The governing principles advocated by President Vailas, as evidenced by administrative rewriting of the faculty-approved draft constitution ,contradict NWCCU accreditation standards, contradict nationally recognized university best practices, and deny to ISU faculty the rights, responsibilities, and academic freedom granted by the SBOE to the faculties of Boise State University and the University of Idaho."

- Motion to signify that the work done so far on the Preamble is appropriate and to give it a non-binding approval for the time being. Seconded by Bishop. Motion passed.
- Motion that Article I also be given a non-binding approval at this time. Motion passed unanimously.
- Motion that Article II be given non-binding approval by the Provisional Faculty Senate as a signal to the subcommittee that their work so far is fine.

Motions passed:
- Motion to post the Nov. 30, 2011 Idaho Supreme Court Ruling on Protected Speech on the Faculty Senate’s webpage.
- Motion to create a PFS subcommittee to draft new Faculty Senate bylaws based on the previous Senate bylaws.
- Motion that the composition of the subcommittee be formed from the larger Division or Colleges, including one member from each of the Division of Health Sciences, the College of Arts & Letters, the College of Science & Engineering, and the College of Technology, and one member from either the College of Business, or the College of Education, or the Library with the provision that at least one of these five members be from the Outreach campuses.
- Motion to have the Provisional Faculty Senate meet weekly next semester as normally scheduled, barring holidays.
- Motion that the Bylaws subcommittee begin their work no later than January 9, 2012 and attempt to forward their findings to the PFS one to two weeks of the PFS being asked to consider their findings. Material not posted by the PFS more than two business days ahead of the meeting can be unilaterally postponed for discussion at the request of any Senator.
- Motion to appoint the Bylaws subcommittee members on Monday, January 9, 2012. Nominations should be submitted prior to the meeting.

- Motion to request that Dr. Vailas and Dr. Adamcik attend the December 12 Provisional Faculty Senate meeting to clarify the November 30th memo and the processes referred to therein.

Motions passed:
- Motion to have the Provisional Faculty Senate forward the current draft of the constitution to President Vailas for his review and approval in accordance with SBOE policy III.C.2 and the SBOE motions passed on April 21 and February 17, 2011. The Provisional Faculty Senate requests that President Vailas announce his decision by December 6, 2011.
- Motion to have the Provisional Faculty Senate forward the current draft of the constitution with a cover letter and the memo stating the voting results to the Executive Director of the Idaho State Board of Education with the request that it be distributed to SBOE members as an informational item.
- Motion to invite President Vailas to the Provisional Faculty Senate on December 5 or 12, 2011, to communicate his views on the constitution that was ratified approved by a two-thirds majority of the faculty.

Motions passed:
- Motion to open nominations for a moderator for the Faculty Constitution Open Forum on Wednesday.
- Motion to nominate Senate’s Vice Chair, Dave Delehanty, to be the moderator. Delehanty accepted the nomination. No further nominations were made. Carried. Delehanty will moderate the Faculty Open Forum.
- Motion to have Provost Adamcik present the administration’s viewpoint at the beginning of the Open Forum. She requested the comments be limited to constitution issues, not bylaws.
- Motion to have a paper ballot for the faculty vote. Amended to have the Provisional Faculty Senate's Executive Committee organize the paper ballot vote.
- Motion to hold an extended Provisional Faculty Senate meeting next week and stay as late as necessary to get the Constitution revision done. Amended to start the Senate meeting at 3:00 p.m. next week.

The Chair will request that any comments be received by Thursday, Nov. 3rd. The Chair will also schedule, and invite President Vailas and all faculty to, a university-wide open forum on Wednesday, Nov. 2nd, to discuss the current draft of the constitution.
