SEXUAL DISCRIMINATION

Definition- Sexual Discrimination generally means less favorable treatment based on one’s sex.  The perpetrator may be of the same sex or the opposite sex of the person being discriminated against.  Title VII of the Civil Rights Act covers sexual discrimination in educational programs receiving federal financial assistance.  Sexual harassment is a category of sexual discrimination

SEXUAL HARASSMENT

            Definition - Sexual Harassment is behavior that is unwelcome, sexual in nature, and sufficiently severe and/or pervasive so as to create a hostile, offensive, or intimidating work or learning environment.  Such conduct may constitute sexual harassment when it limits the ability of a student to participate in or benefit from his or her education.  Sexual harassment of an employee or applicant for employment is defined as unwelcome sexual advances, request for sexual favors, and/or verbal or physical conduct of a sexual nature by the employer or fellow employees.
